Tree Roots Lifted the Sidewalk: Who Pays and What Actually Fixes It
A slab that has tipped up at one edge is easy to see. What lifted it is the part that decides the bill.
A root lift is a causation question before it is a concrete question. In most cities here, whether a tree caused the damage, and whose tree it was, decides who pays and how much. So the order of work is fixed. Measure the offset at its highest point, establish the cause, and only then price the repair.

Why does the cause change the bill?
Because the local rules are written around cause, not around damage.
Take San Leandro. Its Administrative Code section 8.1.120 splits the same broken sidewalk two ways. If a tree in the public right of way caused it, the City carries part of the cost. If something else caused it, the owner carries much more.
Here is the split, straight from the code.
Tree in the public right of way caused it:
- 1/4 inch to 1/2 inch offset: the City root prunes the tree at City cost.
- 1/2 inch to 1 1/2 inch: the City root prunes and patches or grinds, at City cost.
- 1 1/2 inch or greater: the City places a temporary patch, then repairs by removal and replacement. The Sidewalk Inspector decides the area. The City bears 50 percent of that cost.
Something else caused it:
- 1/2 inch to 1 1/2 inch: the City patches at its own cost.
- 1 1/2 inch or greater: the City repairs by removal and replacement, and the owner bears 100 percent.
Read those two lists next to each other. Same slab. Same crack. Half the cost or all of it, decided by one finding.

How do you measure a root lift?
With a ruler, at the highest point of the offset.
That phrase matters. A lifted edge is rarely level along its whole length. San Leandro's tiers are written against the offset measured at its highest point, so the reading that decides the tier is the worst one, not an average.
The 2010 ADA Standards section 303 use the same kind of thresholds. A change in level up to 1/4 inch may be vertical. A change between 1/4 inch and 1/2 inch has to be beveled at a slope no steeper than 1:2. Anything over 1/2 inch has to be ramped.
So the numbers do real work. They set what the city owes, and they set what an accessible route will accept.
Alongside the height, record four things:
- The tree. Species if you know it, distance from trunk to slab, and who owns the strip it stands in.
- The root. Photograph anything visible at a joint or through a crack.
- The panel. Cracked through, or sound with a moved joint? That decides the method later.
- The date of the last repair, if the panel has been done before. In Berkeley that date is worth money.
Send those photos and the offset reading and ask for a free sidewalk assessment. The measurement comes before the quote.
What do the local rules actually say?
They differ enough that guessing is expensive.
Berkeley. The City pays half under its 50-50 program the first time. If the same tree causes damage again within 10 years, the City states it will pay the full cost of repairs. On a third occurrence the City pays in full, and the owner may request removal of the tree at their own expense. That is why the date of the last repair is the first thing to find. Berkeley also states that all trees in the strip between the sidewalk and the street are City property and may not be pruned or removed by anyone except City staff, even when the tree is causing the damage. Fremont. The 50-50 program is scoped to tree damage only. It covers half the cost up to a maximum of $7,500 total per property. It also covers public sidewalks damaged by trees on private property, which most cities will not touch. It never covers driveway repair, so the driveway approach has to be split out of the quote. Fremont also requires landscaping or mulch across any area where hardscape was removed, plus tree planting to City standards. Details are on the Fremont tree program.
Oakland. A Sidewalk Permit is required for repairs larger than 25 square feet. Where a City tree caused the damage, the City still requires the permit but waives its cost. The City's own page lists a typical permit at $433 for less than 200 square feet, plus about $0.93 per extra square foot, and asks owners to verify permit fees with its Permit Counter. As of 2026 that waiver is a real line off the budget when the causation finding goes the owner's way.
One thing does not change with the cause. California Streets and Highways Code section 5610 still puts the duty to keep the fronting sidewalk safe on the owner of the lot in front. Whether a fall becomes the owner's problem is a separate question, set by local ordinance. Oakland changed its rule in 2019 and Hayward did the same effective December 18, 2025. Can you just cut the root?
Often not, and that surprises people.
In Berkeley, no contractor may touch a street tree at all. Pruning and removal are City staff work. So a Berkeley repair cannot cure the problem by cutting the root that caused it.
That changes the engineering. The fix has to work around a living root. In practice that means rebuilding the base with room for the root, or setting the panel layout so the root runs under a joint rather than under the middle of a slab. A root barrier can redirect new growth downward.
A private tree is a different case. In Berkeley a tree on private property that damages the sidewalk is the owner's to prune or remove, with one exception. A coast live oak carries its own City protections, so those frontages still have to be designed around the tree.
Will grinding hold, or does the panel have to come out?
It depends on the slab, not on the budget.
Grinding takes the high edge down with a diamond wheel until the two slabs meet in a smooth ramp. On a sound panel with a small lip it is fast, there is no cure time, and the walk reopens the same day.
Its limit is the concrete underneath. Grinding removes material, so a thin or spalling slab cannot give up much before the aggregate opens up. That is why slab thickness gets checked before anyone commits to a grind.
Replacement is the answer when the panel is cracked through, badly sunken, or lifted so far that grinding would eat it. Grinding a lip flat while a live root keeps growing under it buys a season, not a fix. A rebuilt base is the version that survives a root that is still growing. The tree is on my property. Does any program still help?
In Fremont, yes. The City's 50-50 program covers replacement of public sidewalks damaged by trees located on private property. Most cities do not go that far. Check the rule for your own city before you assume the answer either way.
How do I prove a city tree caused the lift?
Photograph the panel and the tree in one frame. Note the distance from trunk to slab. Photograph any root visible at the joint or through a crack. Record the offset height at its highest point. Date every photo. That record is what a city inspector reads.
Can I have the tree removed instead?

Do root barriers actually work?
They redirect growth rather than stop it. A barrier set at the right depth pushes new roots down instead of sideways under the slab. It works best when the base is rebuilt at the same time, and it is a design choice made at the measurement, not an add on.
